This Consumer Health Data Privacy Notice (“Notice”) supplements the Breckenridge Pharmaceutical, Inc. (“BPI”, “us” and “our”) Privacy Policy and concerns our processing of health-related data as defined by certain US state laws.

How We May Collect Consumer Health Data

If you or anyone else contacts us to report a potential issue, concern, or complaint related to an adverse event potentially associated with the use of our products (an “Adverse Event”), certain health-related data may be requested or provided, for example data related to your health-related conditions, symptoms, status, diagnoses, testing, treatments, and procedures (“health data”).  

How We Process Consumer Health Data

If you contact us to report a potential Adverse Event, we will process your health data to investigate and respond to your issue, concern, or complaint; to comply with our regulatory obligations, and/or to establish, exercise or defend a legal claim; and for any other purpose required or allowed under applicable law. We may engage third party service providers and vendors to assist us in managing our compliance records and related reporting obligations as described in our Privacy Policy.

How We Disclose Consumer Health Data

We may share your health data with the agencies that regulate our products including the Food and Drug Administration (the “FDA”), in conjunction with our obligations to report Adverse Events to the FDA.  

Rights Related to Your Consumer Health Data

If you are a consumer in a state with laws specifically offering you privacy rights over your health data, subject to certain exceptions, you may have certain rights related to your health data, including rights to confirm processing and access, and to delete or withdraw consent relating to such health data.  In some cases, we may be unable to fulfill your request.  If your request is denied, applicable law may give you a right to lodge an appeal with us.  The response to your request will inform you of any appeal rights you may have and tell you how you may exercise them.  You may request to exercise these rights by:
